This policy explains what information FM Prime Accounting & Tax collects from clients and website visitors, why we collect it, and how it's protected — including the extra protections that apply to tax return information under federal law.

01Scope of this policy

This policy applies to information collected by FM Prime Accounting & Tax ("the firm," "we," "us") through our client engagements, our website, and any forms, calls, or documents you share with us in connection with tax preparation, bookkeeping, or IRS representation services.

It does not apply to third-party sites we may link to, or to information you share with other parties outside our engagement with you.

02Information we collect

To prepare accurate returns, keep clean books, and represent you before the IRS, we typically collect:

  • Identity information — name, address, date of birth, Social Security or Employer Identification Number, filing status, and dependents.
  • Financial information — income documents (W-2s, 1099s, K-1s), bank and investment statements, business ledgers, receipts, and prior-year returns.
  • Business information — entity formation documents, payroll records, and vendor or customer data relevant to bookkeeping.
  • Correspondence — IRS notices, letters, and records of communications between you and our firm.
  • Website data — information you submit through our contact form, and basic technical data described in the Cookies section below.

03How we use it

We use client information only to provide the services you've engaged us for:

  • Preparing and filing tax returns and related schedules
  • Maintaining bookkeeping records and financial statements
  • Responding to IRS notices and representing you in resolution matters
  • Communicating with you about deadlines, documents needed, and engagement status
  • Meeting our own recordkeeping and professional obligations as an Enrolled Agent

04Tax return information

Tax return information is subject to additional protection under 26 U.S.C. § 7216 and its regulations. As a matter of federal law, we may not use or disclose your tax return information for any purpose beyond preparing your return without your prior written consent, other than the narrow exceptions the law itself permits (such as under a valid court order).

If we ever ask to use your tax information for something outside preparing your return — for example, a referral to another service — we'll ask for your signed, written consent first, as required by law.

05When we share information

We don't sell client information, and we don't share it for marketing purposes. We disclose information only:

  • To the IRS and relevant state tax authorities, as required to file and support your returns
  • To service providers who support our practice (such as secure document storage, tax software, or a bookkeeping platform), bound by confidentiality obligations
  • To another professional if you've given specific written consent, as described above
  • When required by law, subpoena, or valid court order

06How we protect it

We maintain a written information security program consistent with the FTC Safeguards Rule and IRS guidance for tax professionals (IRS Publication 4557), including:

  • Encrypted, access-controlled storage for client documents
  • Secure client portals for exchanging sensitive documents, rather than unencrypted email where avoidable
  • Limited internal access to client files on a need-to-know basis
  • Multi-factor authentication on systems that hold client data

No system is perfectly secure, and we'll notify affected clients promptly if we ever become aware of a breach involving their information, consistent with applicable law.

07How long we keep it

We retain client records for as long as needed to provide services, meet IRS and state recordkeeping requirements, and support you in the event of a future audit or notice — typically a minimum of the period required by applicable tax law. After that, records are securely destroyed or permanently de-identified.

08Your choices & rights

You can ask us at any time to:

  • Provide a copy of the personal information we hold on your behalf
  • Correct inaccurate information in your file
  • Withdraw a previously given consent for a non-preparation use of your tax information, on a going-forward basis

09Cookies & website data

Our website may use basic, first-party cookies or analytics to understand how visitors use the site (such as which pages are viewed). This is aggregate, non-identifying data and is separate from the confidential client information described above. If you submit our contact form, that information is used solely to respond to your inquiry.

10Children's privacy

Our services are directed at adults and businesses. We don't knowingly collect information directly from children, though a dependent's information may appear within a client's own tax documents as part of normal return preparation.

11Changes to this policy

We may update this policy as our practices, tools, or legal obligations change. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be communicated to active clients directly.
